A recap to refresh memories.
- The Marlin Group comprising of the Ponsonby Mall Trust Ltd, Crummer Trading Trust Ltd, Pollen Developments Ltd and Soho Square Development Ltd is in receivership.
- Marlin gained consents for a development at Soho Square early 2008 and wanted to extend these consents. Planning rules allowed a basic 26,524m² of development on the site at a ratio of 2:1, but through negotiation with Auckland City Council, Marlin was given consents to develop 32,300m², taking building heights through the 12.5m permitted maximum. For its un-consented final proposal, Marlin had a full development target of 47,738m² and a height at one point of 16.7m.
- The Auckland City Council rejected this final target in November 2008.
- Marlin Group appealed this decision to the Environment Court in immediately. They were to produce documents in January 2009. These did not eventuate until June of this year.
- City Fringe Inc as a party to the proceeding along with other groups was informed in January, February and April 2009 of delays in presenting Marlin Group’s appeal. Marlin Group went into receivership mid 2009.
