1. Court proceedings:
Because of a possible jurisdictional issue the timetable for the hearings have been moved out by about 3-4 weeks.
- Auckland City Council Lawyers and Traffic planners are to meet with Ponsonby Mall Trust Ltd (in Receivership) Lawyers and Traffic planners to work together on revisions to the proposal to deal with the jurisdictional issue.
- 20 August 2010: Ponsonby Mall Trust Ltd (in Receivership) is to report back to the court as to whether the issue has been resolved.
If is has the new timetable is as follows:
- 10 September 2010: Ponsonby Mall Trust Ltd ( in Receivership) as the respondent and all 274 parties in support of the proposal are to file and serve evidence.
- 8 October 2010: all other parties are to file and serve their evidence ( ASB Community Trust, City Fringe, Auckland City Council).
- 22 October 2010; rebuttal evidence is to be served by Ponsonby Mall Trust Ltd ( in Receivership)
- 12 November 2010 all caucusing statements of expert witnesses to be filed along withall evidence for the Court.
I expect we will be telephone conferencing with all parties immediately after 20 August to get an up date.
In the meantime rumours abound as to whether the receiver has sold the site. Nothing has been announced formally. We wait with interest.
2. Help Needed:
City Fringe has received advice from a very reputable environment lawyer. It will cost to take our case to the Environment Court. All donations will be gratefully received and a receipt will be issued on request.

Auckland City Council has challenged the latest plans of the Ponsonby Mall Trusts Ltd (in receivership) on a jurisdictional matter. It feels the new plans bring up many new issues which were not covered under the previous submission hearings. In other words it is a different proposal to that which gained some resource consent in 2008 and should go out to the public.
We will all await the Judges ruling with interest. |
